Air carriers that wish to operate scheduled international air services to, from, via or partly within the European or Caribbean part of the Netherlands need to apply for a route permit from TRACON. The Caribbean part of the of the Netherlands consists of the public bodies of Bonaire, Sint Eustatius and Saba.  

Definition

A scheduled international air service is considered to be a series of flights that possesses all the following characteristics:

  • It passes through the airspace over the territory of more than one State;
  • It is performed by aircraft for the transport of passengers, mail or cargo for remuneration, in such a manner that each flight is open to use by members of the public; 
  • It is operated, so as to serve traffic between the same two or more points, either according to a published timetable, or with flights so regular or frequent that they constitute a recognizably systematic series.

Permit conditions

A route permit can be issued to an air carrier under the condition that: 

  • the air carrier has been designated under a bilateral air service agreement between the Netherlands and the other country in question and that the filed route and requested traffic rights fall within the scope of the agreement; or
  • the application of the air carrier falls under the scope of an EU comprehensive Aviation Agreement with one or more third countries. A route permit is not necessary if the EU comprehensive Agreement in question only requires that the air carrier files its planned operations. TRACON will subsequently acknowledge receipt of the filing of the air carrier and
  • If applicable, a European Aviation Safety Agency (EASA) Third Country Operators (TCO’s) authorization has been obtained.

Additional assessment criteria

Aside from the abovementioned conditions, additional assessment criteria may be used with regard to the broader social and economic importance of the permit application, and the effects that granting a permit would have on the entire air network for the Netherlands.

Commercial arrangements

Commercial and/or cooperative marketing arrangements such as code-sharing and leasing arrangements  between an operating air carrier and a marketing air carrier on routes to, from or via the European part of the of the Netherlands need to be filed for approval by the operating air carrier that operates on the basis of a bilateral or EU comprehensive air service agreement at TRACON by using the following forms:
